Decision Delayed In Case Corporation Court Judge Frank Richardson has delayed decision on a writ of heabeas corpus hearing Tuesday until further study of similar cases is made. Attorney Stephen D. Martin Jr. said he would make a study of similar cases and present his findings to the judge.

Judge Richardson said he would give written opinion when the study is completed. The hearing was for George Staples who was convicted. of unauthorized use an automobile in 1962 and I sentenced to five years in the State Penitentiary. Staples was then released on his own recognizance to return to court in two days. On a practice known as banishment, he was then instructed not to return to court and stay away from the area.

and he wouldn't have to serve the sentence, If Staples did have to return to the area within the five year period, he was instructed to call the Chief of Police or the Commonwealth's Attorney, John J. Hartley. Staples did return in December 1965 and was picked up for being drunk in public few hours later. After discovering that a capias had been issued for Staples, City Police sent him -to serve his- sentence in the State Penitentiary. No hearing was ever held on why he returned to Martinsville and this is largely the basis for his habeas corpus He has been serving his sentence since his arrest in 1964.
